§ 1 Scope, Customer Information

The following General Terms and Conditions govern the contractual relationship between Plumeria.Shop and the consumers and entrepreneurs who purchase goods through our shop. Contradictory or deviating terms of the entrepreneur are not recognized by us. Our offer is directed at commercial customers in the field of nail care. These GTC also include customer information according to the BGB Information Ordinance. The language of the contract is German.

§ 2 Conclusion of Contract

(1) The offers on the internet represent a non-binding invitation to you to purchase goods.

(2) After entering your data and clicking the order button, you submit a binding offer to conclude a purchase contract. You can also place a binding order by phone or by fax. The immediate confirmation of receipt of your order via email or fax does not yet constitute acceptance of the purchase offer.

(3) We are entitled to accept your offer within 1 day by sending an order confirmation via email. If the period mentioned in sentence 1 expires without result, your offer is considered rejected, i.e. you are no longer bound by your offer. In the case of a telephone order, the purchase contract is concluded if we immediately accept your offer. If the offer is not accepted immediately, you are also no longer bound by it.

§ 3 Customer Information: Storage of the Offer Text

The contract text containing details about the article is stored by us. You do not have internet access to the contract text.

§ 4 Customer Information: Correction Notice

You can correct your entries at any time before placing the order. We will inform you of your correction options during the ordering process.

§ 5. Revocation
If you are not satisfied with the delivered goods, you can exercise your right of withdrawal. We have the option of exchanging the goods or refunding the purchase price.

§ 5.1 Return Shipping Costs in Case of Withdrawal

In the event of withdrawal, you must bear the costs of return shipping.

§ 6 Retention of Title

The purchased item remains our property until full payment.

§ 7 Limitation of Your Warranty Claims

(1) Warranty for Consumers Regarding Used Goods

Your warranty claims due to defects in used goods expire one year from the handover of the sold item to you. Excluded from this regulation are claims for damages, claims due to defects that we have fraudulently concealed, and claims from a guarantee we have taken on the quality of the item. The statutory limitation periods apply to these excluded claims.

(2) Warranty for Entrepreneurs

Your warranty claims due to defects in the purchased goods expire one year from the transfer of risk. Excluded from this regulation are claims for damages, claims due to defects that we have fraudulently concealed, and claims from a guarantee we have taken on the quality of the item. The right of recourse under § 478 is also excluded.BGB. The statutory limitation periods apply to these excluded claims.

§ 8 Limitation of Liability

We exclude liability for slight negligent breaches of duty, provided they do not relate to essential contractual obligations, harm arising from injury to life, body or health, or guarantees, or claims under the Product Liability Act. The same applies to breaches of duty by our vicarious agents and our legal representatives. Essential contractual obligations particularly include the obligation to hand over the item to you and to transfer ownership to you. Furthermore, we are obliged to provide you with the item free of material and legal defects.

§ 9 Jurisdiction
The jurisdiction for all legal questions is Karlsruhe, Germany.

§ 10 Export
The import of products purchased from us into other countries may only be carried out in accordance with the statutory import regulations. Every buyer must inform themselves of the regulations in advance!
The shipping of our products is exclusively from Germany

 

(3) Important Information Regarding Cuttings

Please note that cuttings are intentionally intended for enthusiasts and experienced plant lovers. Unlike well-rooted plants, cuttings always carry a certain risk, as their further development depends heavily on proper care after receipt.

Even minor care mistakes, unsuitable locations, or well-intentioned measures such as re-cutting or placing the cutting in water can cause it to be damaged or fail to take root within a short time.

Therefore, we ask for your understanding that we cannot accept returns or claims for cuttings due to later development or failure. By purchasing a cutting, you are consciously choosing a product that requires special care, patience, and experience.
